Rideshare Insurance in NYC: TLC Requirements, Coverage Gaps, and What Uber/Lyft Drivers Need in 2026
NYC rideshare insurance is fundamentally different from rideshare insurance anywhere else in the US. While drivers in most states only need a rideshare endorsement on their personal policy, NYC requires full TLC (Taxi and Limousine Commission) commercial insurance. Here is what you actually need.
NYC vs Rest of New York State
NYC requires TLC commercial insurance. If you drive for Uber or Lyft in NYC, a standard personal policy with a rideshare endorsement is NOT sufficient. Outside NYC (Albany, Buffalo, Rochester, Long Island), standard NY state TNC (Transportation Network Company) rules apply and a rideshare endorsement is adequate.
The Three Phases of Rideshare Coverage
| Phase | Status | Coverage Required (NYC) | Coverage Required (Rest of NY) |
|---|---|---|---|
| Phase 1 | App off - personal use only | Personal auto policy. TLC commercial not active. | Personal auto policy. Standard personal coverage applies. |
| Phase 2 | App on, waiting for request | TLC commercial insurance must be active at all times vehicle is logged in | TNC coverage: 75/150/25 BI/PD + NY PIP + UM required |
| Phase 3 | Passenger matched or on trip | TLC commercial with $1M+ BI. $100K PIP (updated March 2026). | $1.25M BI liability required. TNC commercial coverage. |
The Phase 1 coverage gap is the most dangerous: your personal policy may exclude rideshare use. Read your policy exclusions carefully. Many standard NY insurers automatically exclude coverage if you use your vehicle for hire.
NYC TLC Insurance Requirements (2026)
Commercial TLC insurance mandatory
Personal auto policies are not accepted by the TLC regardless of rideshare endorsements. You need a full commercial policy through a TLC-approved insurer.
$100,000 PIP (updated March 2026)
TLC updated its PIP requirement to $100,000 in March 2026, double the state minimum of $50,000. This applies to all TLC-licensed vehicles.
TLC license required
You must obtain a TLC for-hire vehicle license before driving for Uber, Lyft, or other TNCs in NYC. This is separate from your NY driver's license.
Vehicle inspection
TLC-licensed vehicles must pass annual TLC inspections. Your vehicle must meet specific age and condition requirements set by the TLC.
Named driver coverage
NYC TLC commercial policies must cover all drivers who operate the vehicle for hire. If you share your vehicle with other TLC drivers, all must be named on the policy.
TLC Commercial Insurance Cost
Annual cost range
$6,000-$15,000/yr
Main factors
- + Vehicle age and type
- + Driving record and TLC history
- + Number of named drivers
- + Deductible level
Outside NYC: Standard Rideshare Endorsements Apply
For Uber or Lyft drivers operating outside NYC (Long Island, Westchester, upstate NY), New York state TNC Article 44-B rules apply. A rideshare endorsement on your personal policy is sufficient, at a cost of $15-$30/month.
| NY State TNC Phase | Minimum Required |
|---|---|
| App off (personal use) | Personal auto policy minimum (25/50/10 + $50K PIP + UM) |
| App on, no passenger (Phase 2) | 75/150/25 BI/PD liability + NY PIP + UM when app is on |
| Passenger in vehicle (Phase 3) | $1,250,000 combined single limit BI liability coverage |

Tax Deduction: Rideshare Insurance Is a Business Expense
If you drive for Uber, Lyft, or other TNCs, the portion of your insurance premium attributable to rideshare use is tax-deductible as a business expense. The IRS allows Schedule C deductions for the business-use portion of insurance costs.
Example: If you drive 60% for rideshare and 40% personal use, 60% of your total insurance premium is potentially deductible. For a $10,000 TLC commercial policy, that is a $6,000 deduction. Consult a tax professional for specific guidance on your situation.
